1.  Orders

1.1.  Byron Botanist reserves the right, in its absolute discretion, to

(a) amend, remove or vary the products we sell on
this site;

(b) refuse any sale of our products and to refuse any
orders; and/ or

(c) amend or vary our terms and conditions.

1.2.  Our products are in high demand.  We do our best to ensure we will always have stock ready for dispatch however sometimes certain products may not be available or there may be a wait before those items are ready for dispatch. In these circumstances we will update you as to the status of these products and work with you to find a solution!

 

2.  Payment information

 

2.1.  Payment online can be made via a secure checkout facilitated by Shopify and is subject to Shopify’s terms and conditions. Byron Botanist makes no representations as to the services provided by Shopify and bears no risks or liability for any services provided by Shopify during the placement of an order.   Although Byron Botanist makes all reasonable efforts to protect the security of your information, we cannot always guarantee that information transmitted on or through the Internet will always be secure.

2.2.  All prices are quoted in AUD ($) and include any applicable Goods and Services Tax (GST) for Australian customers. 

3.  Delivery information

3.1.  Free shipping on orders over $150 AUD for all orders in Australia.  Free shipping is applied to orders over $150 AUD on total value in your cart after any discounts (if applicable) have been applied.

3.2.  For all deliveries under $150 AUD we charge a $9.95 AUD flat rate for standard shipping.

3.3.  We aim to dispatch all orders within 3 business days, however we cannot guarantee that we will always be able to meet this timeframe.  Delays may be experienced during peak promotional times (such as during the Christmas & New Year festive season, valentine’s day, mother’s day and father’s day).  In these uncertain times we may also experience delays due to COVID and any COVID related restrictions.  In such instances we will do our best to work with customers to dispatch their order as soon as possible. 

3.4.  Whilst Byron Botanist will do everything possible to ensure your order is shipped and delivered to its destination as soon as possible, we also cannot guarantee, nor do we have control over, the actions of the shipping contractors and delivery partners we work with to deliver your order to you.  Once an order is dispatched, Byron Botanist bears no risk or liability for the order including the timing for deliveries and or risk or liability for orders lost, damaged, misplaced or delivered late. In such circumstances you must notify Byron Botanist within 24 hours of delivery. It will be your
responsibility to contact the shipping company to ascertain the status of your order delivery.  We also bear no risk or liability in the event you have provided incorrect, incomplete or insufficient recipient address or if your parcel is rejected or not promptly collected from its delivery address (or the relevant Post Office to the extent your order is delivered to a local Post Office and there is an allocated time frame for collection).

3.5.  Domestic deliveries will automatically default to ‘authority to leave’ and will be left in a safe place at the nominated delivery address, or taken to the local Post Office should the driver deem there is nowhere safe to leave a parcel. You will be notified of the delivery and location of your item via the email address provided at the time you placed your order.

3.6.  Deliveries to Queensland, Western Australia, Victoria and NSW are currently experiencing extensive delays due to border closures and lockdown restrictions.  We will provide an estimated time of delivery received from the Shipping company or delivery partner once an order has been placed.

3.7.  Byron Botanist does not currently ship internationally… though watch this space we will be at your international doorstep soon!

4.  Refunds & Returns policy

4.1.  This policy is subject to (and does not exclude, replace or limit) any additional rights consumers have according to law including under Consumer Guarantees of the Australian Consumer Law, regulations or otherwise as required by law.

4.2.  As a consumer, you are entitled to certain guarantees in respect of goods and services purchased from Byron Botanist. Where you believe an item is faulty or defective, it may be necessary for us to send your goods to the manufacturer for it to be assessed within a reasonable period of time. If the goods or service has a major failure, you are entitled to (amongst other remedies) reject the good or service and seek a refund, exchange or repair. If the failure is minor, we may, at our discretion and within a reasonable time, provide a replacement or refund.

4.3.  If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

4.4.  Byron Botanist will require satisfactory proof of purchase before providing a remedy under the Australian Consumer Law.

4.5.  Byron Botanist does not make any representation or provide any additional warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of fitness for a particular purpose, durability, title, merchantability and merchantable quality.

4.6.  Where an item is misused by the recipient, abnormally used or used in a manner which is inconsistent with the directions on the packaging, Byron Botanist will not provide a refund, exchange or repair.  You should follow all use and storage directions on packaging carefully.  Byron Botanist bears no risk and liability in such circumstances.

4.7.  To the maximum extent permitted by law, neither Byron Botanist nor its related parties (including but not limited to, its directors, officers, employees, agents, contractors, suppliers) be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, revenue loss, profit loss, data loss, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Byron Botanist website or any products purchased from Byron Botanist.

4.8.  We do not provide refunds or exchanges simply for change of mind once an order has been dispatched.

4.9.  If an order has not been dispatched and you wish to change or cancel your order and request a refund we will, if there is a difference in the value of the changed order or if an order has been cancelled, arrange a partial or full refund (as applicable) minus any refund processing fees charged by our third party provider, Shopify, who facilitates the sale.

4.10. Tracking details are forwarded to the email address provided at time of ordering (be sure to check your junk/spam folder). It is the responsibility of the recipient to monitor the tracking of the parcel.

5.  Privacy Policy

5.1.  We are committed to protecting your confidential information in accordance with the Australian Privacy Principles and the Privacy Act 1988 (Cth) which may be accessed here https://oaic.gov.au/privacy-law/.  

5.2.  We collect information about you including your name, delivery address, phone number, email address and payment information solely for the purpose of processing your order and, to the extent you have signed up to receive our newsletter and promotional materials, to provide product updates and other promotional correspondence.  By placing an order or providing your information to us you consent to its collection and use by Byron Botanist and its contractors, third parties and delivery partners in order to fulfil your order.

5.3.  The Byron Botanist website is hosted by a third party.  Whilst we will always do our best to protect the privacy of the information you provide us, sometimes transmissions made on or through the internet cannot be guaranteed to be entirely secure.  We also cannot control the action or inaction of third parties in such instances and during the order fulfilment process.

5.4.  We may use cookies to facilitate site operation and functionality as well as to improve our product offerings and customer service. Some cookies we use are essential and others are used to collect statistical information about the use of the website so that we can improve the site, products and user experience features. Some cookies are temporary and others may stay on your computer.

5.5.  If you have signed up to receive our newsletter and promotional materials and no longer wish to receive the same or if you wish to access and alter or update your information at any time, please use the contact form above to contact us.
